Terms of purchase

Delivery: The purchase process is divided into a number of steps where you provide the information we need to fulfil the order and delivery.

1) Select the product(s) you want to buy and add them to your basket.

2) When you are in the "shopping basket", check that you have selected the right products. Choose the delivery method that suits you best, the price will be automatically updated based on the choice you make. The price indicated is your total price for product and delivery including VAT.

3) In this step, choose the way you want to pay for your order. Fill in all the fields. If you choose to pay by card, via direct payment or by invoice, you will be forwarded to our partner Paynova, which handles the actual payment and contact with banks and financial institutions. NorthTracker AB will never come into contact with your card or bank details.

4) You have now been forwarded to Paynova. All information you provide is sent with the highest possible security encryption directly to Handelsbanken, the acquiring bank. NorthTracker AB has no access to account or card information. Please fill in all the boxes and check that the information is correct. In some cases, your address will be taken from the population register and cannot be changed.

5) Confirm that the information is correct, if there is anything you want to change, you can go back using the "back" button in your browser. Once you confirm the information, the order will be finalised.

6) You have now been sent back to NorthTracker and have been given an order number and a summary/receipt of your order, please print this for reference. To simplify communication and make it easier for us to help you, it is good if you always have your order number available when you contact us.

Is it safe to shop online? We co-operate with VISA and MasterCard. The system aims to identify the cardholder when making purchases online. The identification is done in a similar way to withdrawing money from an ATM. The system is based on the use of a personalised code at the time of purchase. With this technology, the cardholder can be sure that his or her card is not used by unauthorised persons.

What happens after I have ordered? Once you have placed an order, you will receive a confirmation email to the address you provided in the order. This email will contain your order number, so please have this handy if you need to contact us.

How are products delivered? The vast majority of products are delivered after 2 to 5 days.

If you have chosen delivery by Postens värdepaket, you will be notified by the post office and can pick up your parcel at the delivery point. If you have chosen home delivery with UPS, you will be notified when the delivery will take place. For security reasons, you will need to sign for the parcel and provide proof of identity upon delivery. The goods will not be handed over to anyone other than the customer. Delivery will take place during daytime hours and UPS will only be able to attempt delivery on three separate occasions. If delivery is not possible, the product will be returned to NorthTracker. There, a new delivery can be ordered (against payment).

Warranties and insurance: We know that many people who are thinking about buying online may be unsure about how warranties and insurance work. That's why we've gathered all the relevant information on this page. Buying a tracker from NorthTracker is just as safe and secure as buying it in a shop. Below you can read in detail about how it works and how you as a consumer are protected.

Manufacturer's worldwide warranty: All products sold by NorthTracker AB have the manufacturer's official warranty. Therefore, you have a one-year warranty on your tracker.

What do I do if the tracker breaks? Trackers covered by the manufacturer's worldwide warranty can be returned to NorthTracker in Sweden. Please contact our customer service first.

The manufacturer's worldwide warranty does not apply in the following circumstances: 
- if the serial number has been removed or changed
- damage resulting from improper care, neglect or misuse
- damage not due to material or manufacturing defects
- moisture damage to non-waterproof products - damage resulting from interventions carried out by anyone other than an authorised dealer.

Right of return and cancellation: As a customer of NorthTracker AB, you have a full right of return for fourteen days after you receive the goods, in accordance with the Distance Selling Act.

The product must be returned unused in its original packaging, with all seals and seals unbroken. All documentation such as warranty certificates and other certificates must also be returned unbroken.

Returns should be sent to NorthTracker AB, Box 170 60, 167 17 Bromma. We recommend that you insure the shipment as we are unable to take any responsibility for it. You as a customer will be responsible for the cost of the return, in accordance with the Distance Selling Act. We do not accept any returns via cash on delivery. Always contact NorthTracker before returning a product.

Notice of cancellation must be given in writing to: info@northtracker.com. Cancellation must be made at least 3 months before the new annual period.

Product confidentiality rules

This Privacy Policy describes NorthTracker's policies and procedures regarding the use of NorthTracker's location tracking products and services (the "Services"). This Privacy Policy complements and supplements the Privacy Policy available at www.northtracker.com (the "NorthTracker Base Website") which describes NorthTracker's privacy policies and practices with respect to the use of the Website.

Information that NorthTracker collects to provide the Services

After you have purchased a NortTracker Base, you must visit the northtracker.com website to activate the device and services. You will be asked to provide your name, address, telephone number, email address and payment card information (if applicable) to NorthTracker to activate the Services. The collection, use, storage and disclosure of such information is governed by NorthTracker's Privacy Policy.

NorthTracker collects GPS coordinates showing the location of the device ("Location Information"). The Location Information is collected and processed by NorthTracker in Sweden for the purpose of providing the Services. NorthTracker is committed to protecting the privacy of those who entrust us with their personal information.

You understand that the terms of use (the "Terms of Use") for the NorthTracker Products limit the use of the Device to tracking the location of (i) property belonging to you; or (ii) a minor or other person on whose behalf you have the legal right to give consent. You must inform any person whose location you wish to track in accordance with the Terms of Use, and you represent to NorthTracker that you have the legal right to consent to such use on such person's behalf, and that you do give such consent. You understand that any use of the Services not authorised by the Terms of Use is at your own risk and that NorthTracker shall not be liable for any damages, as set forth in the Terms of Use.

NorthTracker's use of location information

Location information collected through the Services is used by NorthTracker to provide the Services to you. We reserve the right to use and disclose Location Information to others as we deem appropriate: (a) under applicable law or regulation; (b) for law enforcement purposes; or (c) to respond to requests from public authorities and law enforcement officials.

Cancelling the collection and sharing of location information

The collection of location information can be cancelled at any time by switching off the device.

Location information that is saved

NorthTracker stores location information on its servers only for as long as necessary to provide the Services to you or as long as applicable law permits or requires.

Product terms of use

These Terms of Use govern your use of this NorthTracker product and services (the "Services") for location tracking. Please also read the Terms of Use found at northtracker.com which govern the use of the northtracker.com website.

Authorised use of the services

The Services may only be used to track the location of personal property. Any other use of the Services is not authorised by NorthTracker and is done at your own risk.

Without prejudice to the generality of the foregoing, you may not use the Services to stalk, harass, harm, threaten to harm or invade the privacy of any person.

Your wireless data service plan is provided by a third-party wireless service provider. NorthTracker and the third party wireless service provider reserve the right to deny, disconnect, modify and/or terminate the Services, without notice, to anyone who is found to be using the Services or the Wireless Data Service in an unauthorised manner. In addition, the use of content or information may be blocked, temporarily or otherwise, as a result of measures taken by mobile network operators to prevent the (continued) dissemination of information that constitutes a criminal offence or may be illegal in relation to third parties.

Comply with laws and regulations

You agree to use the Services and the Wireless Data Service Plan in accordance with the laws and regulations governing the use of location tracking products and services in your area. NorthTracker and the third party wireless service provider are not responsible for any use of the Services or the Wireless Data Service Plan that violates any law or regulation.

Waiver of certain damages

IN NO EVENT SHALL NORTHTRACKER OR THE THIRD-PARTY WIRELESS SERVICE PROVIDER BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, OR DAMAGES RESULTING FROM LOSS OF DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT NORTHTRACKER OR THE THIRD-PARTY WIRELESS SERVICE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU, IN WHICH CASE SUCH LIMITATIONS OR EXCLUSIONS WILL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

NorthTracker's responsibility

All use of the Services and the Wireless Data Services Plan is at your own risk. NorthTracker and the third party wireless service provider make no representations about the accuracy, reliability, completeness or timeliness of the Services or about the results to be obtained from using the Services, other than the limited warranty applicable to your NorthTracker product.

YOU HAVE NO CONTRACTUAL RELATIONSHIP WITH THE WIRELESS SERVICE SUBCONTRACTOR AND YOU ARE NOT A THIRD-PARTY BENEFICIARY OF ANY AGREEMENT BETWEEN NORTHTRACKER AND THE SUBCONTRACTOR. YOU UNDERSTAND AND AGREE THAT THE SUBCONTRACTOR HAS NO LEGAL, EQUITABLE OR OTHER LIABILITY OF ANY KIND TO YOU. IN ANY EVENT, REGARDLESS OF THE REMEDY, WHETHER FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY OR INFRINGEMENT OR OTHERWISE, YOUR SOLE REMEDY FOR ANY CLAIM ARISING IN ANY WAY IN CONNECTION WITH THE TERMS OF USE, FOR ANY REASON, INCLUDING BUT NOT LIMITED TO FAILURE OR INTERRUPTION OF THE SERVICE PROVIDED UNDER THE AGREEMENT, SHALL BE LIMITED TO PAYMENT OF DAMAGES NOT TO EXCEED THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWO-MONTH PERIOD PRECEDING THE DATE THE CLAIM AROSE.

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE WIRELESS SERVICE PROVIDER, AND ITS OFFICERS, EMPLOYEES AND AGENTS, FROM AND AGAINST ANY AND ALL CLAIMS, INCLUDING WITHOUT LIMITATION, CLAIMS FOR DEFAMATION, LIBEL OR ANY PROPERTY DAMAGE, PERSONAL INJURY OR DEATH ARISING IN ANY WAY, DIRECTLY OR INDIRECTLY, IN CONNECTION WITH THESE TERMS OF USE OR WITH THE USE, NON-USE OR INABILITY TO USE THE SERVICE, EXCEPT WHERE THE CLAIMS ARE CAUSED BY THE GROSS NEGLIGENCE OR WILFUL MISCONDUCT OF THE SUBCONTRACTOR. THIS DECLARATION SHALL SURVIVE THE EXPIRY OF THE TERMS OF USE.

YOU UNDERSTAND THAT NORTHTRACKER AND ITS SUBCONTRACTORS CANNOT GUARANTEE THE SECURITY OF WIRELESS TRANSMISSIONS AND ARE NOT RESPONSIBLE FOR ANY BREACH OF SECURITY IN CONNECTION WITH THE USE OF THE SERVICES.

THE SERVICE IS FOR YOUR USE ONLY AND MAY NOT BE RESOLD TO ANY OTHER PARTY.

Validity and expiry of the conditions

These Terms of Use will continue to apply for as long as you use the Services provided, provided, however, that your use will automatically terminate without notice from NorthTracker if you fail to comply with any of the terms. NorthTracker also reserves the right to cease offering any data or services provided by any third party if such provider ceases to provide such data or services to NorthTracker or if NorthTracker's agreement with such provider is terminated for any reason.

NorthTracker Privacy Policy Programme

NorthTracker is committed to privacy and wants you to know how we collect, use and disclose personal information when you use our products and programmes.

This Privacy Policy ("Privacy Policy") describes our practices in connection with information we collect through our products and applications, through a user account registered on northtracker.com, or when you interact with our support staff. Where we process information that legally requires your consent, we will ask you for such consent. You can withdraw your consent at any time. Other NorthTracker sites, or certain activities on other sites linked to NorthTracker, are subject to privacy policies that differ from those set out below. We recommend that you read the privacy policy of each NorthTracker site you visit.

We are committed to handling the information we receive in accordance with PuL (Personal Data Act) and EkomL (Electronic Communications Act). 1. WHAT KIND OF INFORMATION DOES NORTHTRACKER COLLECT?

We collect two basic types of information: "Personal Information" and "Impersonal Information".

1. Personal Information: We collect Personal Information used in connection with your NorthTracker account or when you contact our customer service. Examples of such information include name, address, telephone number, email address and account details. We may combine the information you submit through your account with information we collect from your products or programmes, or that we receive from third parties, in order to provide you with programmes and services and to improve the quality of our products and programmes. We may also collect Personal Information when you use our products and applications or activate certain features of any of our products or a personal navigation device. Such Personal Information may include location information collected from wireless devices or from mobile phone masts.
2. Impersonal Information: NorthTracker also collects Impersonal Information from personal navigation devices. If a device is not registered on NorthTracker, the information collected is not linked to any individual user and therefore this is Impersonal Information. For example, NorthTracker may collect information about how often a device is switched on and how long or how often certain applications and features of the product or service are used. When you use a NorthTracker product and application or access your account on northtracker.com, we automatically record log information. These server logs include information such as your IP address, browser type, browser language, date and time of request, and times of your visits. Under certain laws, such information is considered Personal Information.
3. NORTHTRACKER'S USE OF INFORMATION
4. Personal Information: We may use Personal Information about you for the purposes set out below. If we intend to use Personal Information about you for a purpose that is not consistent with those listed below or if we intend to disclose Personal Information about you to a type of third party not previously disclosed in this Privacy Policy, we will notify you and give you the opportunity to prevent such use and/or disclosure.

(i) General. We and our service providers use Personal Information for the purpose of providing you with traffic information and to enable you to update software on your device or to respond to a customer service request. We may also use Personal Information about you for our internal operations, such as measuring customer satisfaction and improving our products and services.

(ii) Location information. NorthTracker's navigation software and products collect and transmit information such as your location, speed and direction to enable us to improve our and our strategic partners' products and software, to make more accurate time-of-arrival calculations and to extend mapping capabilities.

(iii) Track logs. When you connect your device to a computer via a USB port, you transfer certain history information from your device to NorthTracker, including location and time information. We and our third-party software and content providers then use that information to improve our and their products and programmes.

(iv) Communication. We may use Personal Information about you to send you information about NorthTracker's programmes, invite you to participate in special programmes, re-contact you if we haven't heard from you in a while and, on occasion, electronically send you advertising and promotional materials about NorthTracker and the products and programmes of selected partners. You can opt-out of such promotional communications. However, regardless of what you opt out of, NorthTracker may occasionally send you emails for administrative and transactional reasons (e.g., to provide you with important information about northtracker.com or a product or service, or to notify you of changes to our terms and policies). Because it is important that you receive such information in order to use northtracker.com or our products and programs, you cannot opt out of such communications.

(v) Customer Support. When you contact our customer service representatives by email, phone, or in person, we may collect information relevant to that contact, such as your name and phone number, email address and contact information, which NorthTracker products you own, their serial numbers and purchase dates, and information about a support or service issue.

(vi) Compliance with applicable laws. We may need to collect and retain Personal Information about you to comply with applicable laws and to respond to requests from public authorities, including public authorities outside your home country.

1. Non-Personal Information: Because you cannot be identified through Non-Personal Information, we may use such information for various purposes such as improving our products and programmes. We reserve the right to share Non-Personal Information, which does not personally identify you, with third parties for any purpose.
2. Server Log Information: We and our service providers use server log information, such as IP addresses, for such purposes as calculating website usage levels, diagnosing problems with northtracker.com's servers, administering northtracker.com, and for other related purposes, and we may disclose IP addresses as set forth below. Collecting IP addresses is standard Internet practice and is automatic on many websites. Please note that we treat IP addresses, server log files, and related information as Personal Information, unless otherwise required by applicable laws.
3. DISCLOSURE OF INFORMATION

As described above, NorthTracker may share Personal Information, including information you provide on northtracker.com or information collected through our products or services, with third parties located anywhere in the world.

Affiliated Organisations: We may share information, including Personal Information you submit on northtracker.com or through our products or services, with our subsidiaries and affiliated organisations worldwide for the purposes described in this Privacy Policy. Our subsidiaries and affiliated organisations must protect Personal Information about you in accordance with this Privacy Policy. NorthTracker AB is the party responsible for the management of shared Personal Information.
2. Strategic Partner and Affiliate Sites: In some cases, we may enter into special relationships with other companies that are not owned by or affiliated with NorthTracker in order to provide additional features on northtracker.com or special products and programmes. These special relationships may include the websites of affiliates ("Affiliate Sites"). Any information, including Personal Information, that you provide in connection with any of these programmes or products, and/or on any of these Affiliate Sites, will be disclosed to these third party partners. By selecting a programme or providing your information on these partners' sites or by registering for a programme, you consent to the disclosure of Personal Information about you to these third parties. Please note, however, that third parties generally use Personal Information about you in accordance with their own privacy policies and you should check those third parties' websites and read the information about their privacy policies. PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT COVER THIRD PARTY PRIVACY OR INFORMATION POLICIES. If you do not want Personal Information about you to be disclosed to third parties, you should not provide Personal Information in connection with programmes or products provided by third parties and/or on the sites of third party partners.

(i) Location information: When you register for certain programmes, your physical location will be collected from mobile phone masts and satellites and shared with our strategic partners. NorthTracker will share information about your location, speed and direction with the third party traffic information provider to improve the programme, provide accurate traffic information and calculate more precise arrival times. This information is provided in aggregated form.

1. Service Providers: We may use third party service providers to help us operate the business and northtracker.com or to administer activities on your behalf. We may share Personal Information about you with them for these limited purposes. These service providers will have access to Personal Information needed to perform their tasks, but they may not use Personal Information for purposes other than providing services to us. We require that those service providers who have access to Personal Information received from the EEA either adhere to the Safe Harbour Principles or are subject to the EU Privacy Directive or other equivalent decisions or enter into an appropriate written agreement with us.
2. Law Enforcement; Disclosure: We reserve the right to disclose Personal Information about you to others as we deem appropriate: (a) under applicable laws and regulations, including the laws and regulations of countries other than your home country; (b) to comply with legal process; (c) to respond to inquiries from public authorities and law enforcement officials, including public authorities and law enforcement officials in countries other than your home country (d) to enforce our Terms; (e) to protect our business or the business of our affiliated organisations and subsidiaries; (f) to protect the rights, privacy, safety and property of NorthTracker, its affiliated organisations and subsidiaries, you or others; and (g) to enable us to seek redress or limit damages that may arise.

In addition, we reserve the right to transfer any information we collect from users to an affiliated organisation, subsidiary or third party in the event of a reorganisation, merger, sale, joint venture, assignment or other disposition of all or part of NorthTracker's business, assets or stock (including without limitation in connection with bankruptcy or similar proceedings).

4. LINKS, THIRD-PARTY PROGRAMMES AND THIRD-PARTY PRIVACY POLICIES

northtracker.com, as well as our applications and products, may contain links to other websites not operated by NorthTracker. Your product may also contain applications that can be downloaded from third parties. Such linked websites, services and applications (including, without limitation, websites of strategic partners) are beyond the control of NorthTracker, and we are not responsible for the privacy practices or the content of such linked websites, services and applications, nor for any links contained in linked websites, services or applications. We provide such links or programs solely as a convenience, and the inclusion of any links on northtracker.com or in any programs does not imply endorsement or approval by NorthTracker or its affiliated organisations or subsidiaries of the linked websites, services or programs. If you provide Personal Information through any such third party website, service or programme, the transaction takes place within that third party's website, service or programme (not northtracker.com or NorthTracker) and the Personal Information you provide will be collected and governed by that third party's privacy policy. NORTHTRACKER IS NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF SUCH OTHER THIRD PARTY WEBSITES AND PROGRAMMES. NorthTracker recommends that you review the third party's privacy policy.

5. OTHER DISCLOSURES

For some features, you can mark location information (history and driving record) and share that information with third parties. You should be very careful when using those features and when sharing location information with third parties.

6. SAFETY

NorthTracker takes reasonable security measures to prevent the loss, misuse, unauthorised access and unauthorised disclosure or alteration of Personal Information under NorthTracker's control. Unfortunately, however, it is not possible to guarantee the 100% security of any data transmission over the Internet or any data storage system. This means that, while we endeavour to protect Personal Information about you, we cannot guarantee the security of any information you transmit to us through or in connection with northtracker.com or the Applications, or that is stored by us. If you have reason to believe that your interaction with us is no longer secure (e.g., if you feel that the security of any account you have with us has been compromised), you must promptly notify us of the problem by contacting us.

7. JURISDICTIONAL ISSUES

Those who choose to access northtracker.com do so on their own initiative and are responsible for compliance with all local laws, rules and regulations. We may restrict access to northtracker.com, in whole or in part, to any person, geographic area or jurisdiction in our sole discretion, at any time.

8. CHILDREN'S USE OF PRODUCTS AND PROGRAMMES

Our products and programmes are not directed to individuals under the age of eighteen (18), and we require that those individuals not submit information through northtracker.com or through our products and programmes.

We reserve the right to change this Privacy Policy from time to time as we add new products and programmes, as we expand our current offerings, and as technology changes. In the event that we offer downloads of software on a NorthTracker Site and you download such software, such software, including without limitation any files, images included in or generated by the software, and data accompanying the software (collectively, the "Software") is licensed to you by us or third party licensors for your personal and non-commercial home use. We do not transfer any rights to the Software to you. You may not distribute or otherwise exploit the Software or decompile, reverse engineer, disassemble or otherwise transform it into a human-readable form. EXCEPT AS SPECIFICALLY AND EXPRESSLY PROVIDED ELSEWHERE, NORTHTRACKER HEREBY DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WHETHER SUCH WARRANTIES ARE EXPRESS, IMPLIED OR STATUTORY.

NORTHTRACKER SHALL NOT BE LIABLE FOR (1) ANY DEFECT, ERROR OR INACCURACY IN THE SOFTWARE, (2) ANY LOSS OR DAMAGE (INCLUDING WITHOUT LIMITATION CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL AND CONSEQUENTIAL DAMAGES) ARISING OUT OF THE DOWNLOADING OR USE OF THE SOFTWARE OR ARISING OUT OF ANY SUCH DEFECT, ERROR OR INACCURACY IN THE SOFTWARE. IF ANY OF THE ABOVE CONDITIONS DO NOT APPLY DUE TO APPLICABLE LAW, NORTHTRACKER'S ENTIRE LIABILITY SHALL BE LIMITED TO THE APPLICABLE LAW.

Public forums and communication

"Public Forum" means an area, website or feature offered as part of a NorthTracker Site where users have the opportunity to submit content ("User Submissions") for viewing by one or more users of the NorthTracker Site, including without limitation a bulletin board, forum, social community, discussion page or blog.

You understand that Public Forums and the features offered in them are for public and not private communications, and you have no expectation of privacy with respect to any User Contributions to a Public Forum. We cannot guarantee the security of any information you disclose through such media. You make such disclosures voluntarily and at your own risk. You should use your good judgement when posting information, comments or other content regarding users, service providers, NorthTracker or other third parties. You may be held legally responsible for damages suffered by other users, NorthTracker or third parties as a result of illegal or defamatory comments, remarks or other information or content that you post on a NorthTracker website. NorthTracker has no legal liability for User Contributions, even if a User Contribution is defamatory or otherwise objectionable.

You are and remain solely responsible for the User Contributions that you distribute on or through any NorthTracker Site in any General Forum and for the consequences of contributing and posting them. We have no obligation to monitor any General Forum. You will be solely liable for any damages that may result from any infringement of copyright or proprietary rights and for any harm that may be caused by User Contributions.

You acknowledge that your use of or reliance on any User Contributions in the General Forums is at your own risk. For example, we are not responsible for, and we do not endorse, any opinions, advice, or recommendations posted or sent by users in any General Forum, and we specifically disclaim any liability in connection therewith. We do not confirm the qualifications, background or abilities of users or the information they post in any General Forum. Code of Conduct: You certify that you will not post any User Submission on any NorthTracker website as:

involves offence, harassment, intimidation or invasion of privacy of any person
is discriminatory, hateful or otherwise offensive
is violent, obscene, pornographic or otherwise sexually orientated, or otherwise harmful or likely to cause harm to persons or groups
is illegal or encourages or advocates illegal activities or discussions of illegal activities with the intent to commit them, including Contributions from users who are, or represent attempts to engage in, child pornography, stalking, sexual harassment, fraud, dealing in obscene or stolen material, drug trafficking and/or drug abuse, harassment, theft or preparation of criminal activities
infringe or violate the rights of third parties, including: (a) copyrights, patents, trademarks, trade secrets or other intellectual property or contractual rights; (b) the right to privacy (in particular, you may not distribute other people's personal information of any kind without their express permission) or publicity; or (c) any obligations of confidentiality
is commercial, business-related or involves advertising or offering for sale products, services or other items (whether for profit or not), or involves a solicitation (including requests for contributions or gifts)
contains viruses or other harmful components, or otherwise manipulates, degrades or damages the NorthTracker Sites or other connected networks, or otherwise interferes with the use or enjoyment of the NorthTracker Sites by any person or group
(a) is not related to the subject matter or theme of the relevant General Forum; (b) violates any specific restrictions of a General Forum, including age restrictions and procedures; or (c) is anti-social, divisive or destructive, including bullying, spamming, "flooding", provocations and "griefing" as these terms are commonly used and understood on the Internet
is false or misleading. We cannot assure that other users are or will be in compliance with these Rules of Conduct or any provisions of these Terms of Use, and as between you and us, you assume all risks of harm that may result from such non-compliance.

We reserve the right, but disclaim any obligation, to refuse to post, communicate or remove any User Submission on any NorthTracker Site if it violates these Terms of Use (including the Rules of Conduct).

Accounts

Some services on the NorthTracker Sites allow or require you to create an account to participate or to secure additional benefits. You agree to provide, maintain and update true, accurate, current and complete information about yourself as required by our registration processes ("Registration Data"). You agree not to impersonate any other person or entity or falsely claim to be affiliated with a person or entity, including using another person's username, password or account information, or another person's name, characteristics, voice, image or photograph. You also agree to notify us promptly at info@northtracker.com of any unauthorised use of your username, password or account information, and of any other breach of security of which you become aware, involving any NorthTracker Site.

We may suspend or terminate your account and your ability to use the NorthTracker Sites or any part of them if you fail to comply with these Terms of Use or any specific terms associated with a particular Service.

NorthTracker's responsibility

NorthTracker makes no representations about the accuracy, reliability, completeness or timeliness of the Content or about the results to be obtained from using the NorthTracker Sites and the Content. Any use of the NorthTracker Sites and the Content is at your own risk. Changes to the NorthTracker Sites are made periodically and may be made at any time. Certain Content on the NorthTracker Sites may be sourced from third parties, and NorthTracker cannot be held responsible for such third party Content.

NORTHTRACKER DOES NOT WARRANT THAT THE NORTHTRACKER SITES WILL OPERATE ERROR-FREE OR THAT ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MATERIAL. IF YOUR USE OF THE NORTHTRACKER SITES OR CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR IN THE LOSS OF DATA, NORTHTRACKER IS NOT RESPONSIBLE FOR THOSE COSTS.

THE NORTHTRACKER WEBSITES AND CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. Waiver of certain damages

If you are dissatisfied with any of the Content or any other content on the NorthTracker Sites or with these Terms, your sole remedy is to discontinue using the Site. Insurance

You agree to defend, indemnify and hold NorthTracker, its officers, directors, employees and agents harmless from any claim, action or demand, including without limitation reasonable legal and accounting fees, arising out of your breach of these Terms of Use.
